§01About these terms
These terms govern your use of:
- the website at [DOMAIN] (the Site)
- the free FCFCOA SRL Ecosystem starter pack (the Pack)
- the Hosted Workspace MCP service (MCP Hosting)
- the Drive & Gmail Backup service (Backup)
- the Setup & Ongoing Support service (Support)
Together, the Services. By accessing the Site, downloading the Pack, or engaging us for any paid Service, you accept these terms.
DyCom Group Queensland Pty Ltd ("we", "our", "us") is an Australian Proprietary Limited company providing technical infrastructure and software services. We are not a law firm. No member of our team is acting in the capacity of a legal practitioner when providing any Service.
§02The bright line: what we do, and what we do not do
2.1 What we do
- Provide a folder structure, document templates, and workflow guidance for self-represented litigants
- Configure technical tools (Claude Projects, AI assistants, MCP servers, file conversion utilities)
- Host an MCP server that allows your AI assistant to access your own Google Workspace
- Maintain encrypted backups of nominated Drive folders and Gmail labels
- Provide technical setup, troubleshooting, and ongoing technical support
- Build small custom utilities (Apps Script, conversion scripts) on request
2.2 What we do not do
We do not, under any circumstances and regardless of payment, provide:
- Legal advice of any kind
- Drafting of substantive legal content (we will format and tidy, not write argument)
- Strategic, tactical, or settlement advice
- Predictions about outcomes
- Interpretation of court orders, judgments, or legislation
- Advice on whether to accept an offer, file a document, or appeal a decision
- Representation, advocacy, or any service requiring an Australian practising certificate
- Court appearances
- Negotiation with another party or their representatives on your behalf
- Witnessing affidavits or statutory declarations (unless one of us is independently qualified to do so as a JP, lawyer, etc. — in which case we do so in our personal capacity, not as the Service)
If a question you ask us crosses the line from "how do I configure this tool" to "what should I do in my matter", we will redirect you to seek legal advice. This is not because we are unhelpful. It is because we are not your lawyer, and acting as if we were would be dangerous for you and unlawful for us.
2.3 Unauthorised legal practice
In Queensland, providing legal services without a practising certificate is an offence under the Legal Profession Uniform Law (Queensland). We take this seriously. If you find yourself wishing we'd just answer the legal question, we understand — and we still won't. There are pathways for free or reduced-fee legal help (§16) which exist precisely for this gap.
§03The Pack (free)
3.1 Licence
We grant you a non-exclusive, perpetual, royalty-free, worldwide licence to use, modify, share, and redistribute the Pack and its contents. You may share with other SRLs, community legal centres, friends, family — anyone you think might benefit. You may not represent the Pack as your own creation or sell it as-is.
3.2 No warranty
The Pack is provided "as is". We make no warranty that:
- it is suitable for your matter
- it complies with all applicable court rules (rules vary by court, registry, division, and direction)
- it will produce any particular outcome
- it is free of errors
You use the Pack at your own risk. We recommend cross-checking format conventions (e.g. for affidavits) against the rules of the court hearing your matter and any specific directions you have been given.
3.3 Contributions
If you improve the Pack and would like to contribute changes back, contact us at [contributions@DOMAIN]. We will review and credit accepted contributions (anonymously if you prefer).
§04The paid Services
4.1 Engagement
A paid Service begins when:
- you confirm in writing (email or our enquiry form) that you wish to proceed, and
- we confirm acceptance in writing, and
- (for subscription services) the first payment is processed, or (for hourly Services) we begin work.
A separate written engagement letter may be provided for larger pieces of work; if so, that letter governs and these terms apply to the extent they don't conflict with it.
4.2 Scope
The scope of each paid Service is the scope described on the Site, plus any agreed additions in writing. We will not perform work outside that scope without further written agreement.
If during the course of a Service it becomes clear that what you actually need is legal advice (or any other service we don't provide), we will pause, tell you, and recommend you obtain that other service before we continue.
4.3 Pricing and payment
- MCP Hosting: A$30 per month, invoiced monthly in advance.
- Backup: A$15 per month, invoiced monthly in advance.
- Setup & Support: A$120 per hour, 30-minute minimum, 6-minute increments thereafter, invoiced fortnightly in arrears. Ongoing Support is charged at the same hourly rate. Application-based discounts may be available; ask.
- All prices are in Australian dollars and include any applicable GST.
- Payment is due within 7 days of invoice. Overdue accounts may have subscription Services suspended.
4.4 Cancellation and refunds
- Subscription Services (MCP Hosting, Backup): cancel at any time, with 7 days' written notice. Pro-rata refunds are not provided for partial months unless required by Australian Consumer Law.
- Hourly Services: cancel at any time. We will invoice for time already worked.
- Australian Consumer Law guarantees apply and cannot be excluded. If we fail to provide a Service with due care and skill, you are entitled to remedies under the ACL regardless of what these terms say.
4.5 Pauses and account state
You can pause subscription Services for up to 90 days per year at no charge (you keep your configuration; the Service is dormant). After 90 cumulative days paused, the subscription will be cancelled and any backup content will be deleted within 30 days unless you reactivate.
§05The MCP Hosting Service
5.1 What it is
A hosted instance of the open-source taylorwilsdon/google_workspace_mcp server, configured against your Google account, accessible from your AI assistant (Claude, ChatGPT in developer mode, etc.).
5.2 Per-tenant isolation
Your hosted instance runs in an isolated environment: separate operating system user, separate process, separate filesystem namespace, separate OAuth credentials. Access control lists (ACLs) ensure only your assistant session(s) can reach your instance. We do not run shared multi-tenant MCP processes.
5.3 No content storage
The MCP server is a request broker. Content (file bodies, email contents, calendar events, etc.) passes through server memory and is discarded. We log only request metadata as described in the Privacy Policy.
5.4 What you must do
- Maintain your Google account in good standing
- Not use the Service to attempt to access content or accounts you don't own or aren't authorised to access
- Not use the Service for any unlawful purpose
5.5 What we can't promise
- Uptime is best-effort. We target 99% monthly uptime but do not guarantee it.
- Google can change its APIs, deprecate scopes, or revoke access at any time. If that breaks the Service, we will work to restore it but cannot guarantee timing.
- AI assistants change frequently. If Claude, ChatGPT, or another assistant changes its MCP protocol support, we may need time to adapt.
§06The Backup Service
6.1 What it is
Encrypted backups of nominated Google Drive folders and Gmail labels, taken on a [DAILY / SEMI-DAILY] basis, stored in Sydney, Australia, available for restore on request.
6.2 Storage and encryption
- Encrypted at rest using AES-256.
- Encrypted in transit using TLS 1.3.
- Hosted with [HOSTING PROVIDER] in their Sydney availability zone.
- Encryption keys held by us (necessary for restore); access to keys logged.
6.3 Restore
You can request a full or partial restore at any time. Restores are delivered as a downloadable encrypted archive with the decryption key sent separately. Typical turnaround is [24-48 hours]; larger restores may take longer.
6.4 What backup is and isn't for
- ✅ Insurance against account suspension or lockout (Google can and does lock accounts)
- ✅ Insurance against accidental deletion (yours or someone else's)
- ✅ Long-term retention beyond Google's standard retention windows
- ❌ Not a substitute for your own copies of critical material
- ❌ Not a litigation hold (we will retain on subscription; if you need litigation hold features for evidentiary purposes, that's a different kind of service and we don't currently offer it)
- ❌ Not a discovery tool (we won't search your backup for specific content on someone else's request — see Privacy Policy §10)
6.5 Deletion
On cancellation, your backup is deleted within 30 days. You can request immediate deletion at any time during your subscription; we will execute within 7 days and provide written confirmation.
§07The Setup & Ongoing Support Service
7.1 What it covers
Technical setup of the Pack and associated tools, custom utilities, ongoing technical support, troubleshooting, training.
7.2 What it does not cover
(See §2.2 for the comprehensive list. Briefly: anything that requires a practising certificate.)
7.3 How time is recorded
Time is recorded in 6-minute increments after a 30-minute minimum. Reasonable preparation time and follow-up are billable. Travel time, if applicable, is billable at 50%.
7.4 Access and confidentiality
If providing Support requires access to your systems, you grant access only for the duration of the engagement and only to the named individual performing the work. We treat anything we see in the course of the engagement as confidential and bound by the Privacy Policy (§3.6).
We strongly recommend you do not share case content with us during Support. We are not your lawyer; communications with us are not privileged and could in theory be subpoenaed. Where possible, scope Support engagements to technical matters only.
§08Acceptable use
You may not use any Service to:
- Violate any law or regulation
- Infringe anyone's intellectual property or privacy rights
- Distribute malware, attempt to compromise our systems, or interfere with other users
- Conduct activities prohibited by Google's Terms of Service (which apply to your Google account use, including via our Services)
- Harass, threaten, or stalk any person
- Circumvent court orders (including DVOs, FVROs, AVOs, or restraining orders)
Violations may result in immediate suspension of Services and, where appropriate, reporting to law enforcement.
§09Intellectual property
- The Pack: licensed to you as described in §3.1.
- The Site (other than the Pack): copyright DyCom Group Queensland Pty Ltd. You may quote and reference, but not republish substantial portions without permission.
- Open source software we use (including workspace-mcp): subject to its own licence. We honour those licences.
- Anything you create using the Services (e.g. your affidavits, your MWD): yours. We claim no rights in your content.
§10Limitation of liability
To the maximum extent permitted by law (and subject to the non-excludable guarantees of the Australian Consumer Law):
- Our total liability for any claim arising out of or related to a Service is limited to the amount you have paid us for that Service in the 12 months before the claim arose, or A$1,000, whichever is greater.
- We are not liable for indirect, consequential, special, or punitive damages, including loss of profits, loss of data (beyond our backup obligations), or adverse outcomes in your legal matter.
- We are not liable for outcomes in your legal matter under any circumstances. We are not your lawyer. We do not control your matter.
Nothing in these terms limits liability that cannot be limited under Australian law, including the consumer guarantees in the Australian Consumer Law.
§11Indemnity
You agree to indemnify us against claims brought by third parties arising from your use of the Services in breach of these terms (for example, if you use the Services to violate a court order or another person's rights). This indemnity does not apply to our own negligence or breach.
§12Termination
We may terminate or suspend any Service immediately if:
- you breach these terms in a way that is not cured within 7 days of written notice
- you fail to pay an invoice within 30 days of its due date
- providing the Service becomes unlawful or impractical
- you use the Service in a way that is dangerous to you, to another person, or to us
On termination, we will return or delete your data as described in the Privacy Policy.
§13Disputes
If a dispute arises:
- We'll try to resolve it informally. Email [disputes@DOMAIN] with a description.
- If informal resolution fails, the parties will engage in good-faith mediation through the [Queensland Law Society's Dispute Resolution Service / equivalent] before commencing proceedings.
- If mediation fails, disputes will be heard in the courts of Queensland, Australia. These terms are governed by Queensland and Commonwealth law.
This clause does not affect your rights under the Australian Consumer Law or your right to lodge complaints with the OAIC or other regulators.
§14Changes to these terms
We may amend these terms from time to time. Material changes will be notified to active subscribers by email at least 30 days before they take effect. The current version is always at [DOMAIN]/terms.

§15Severability and entire agreement
If any provision of these terms is held unenforceable, the rest remain in force. These terms (together with any separate engagement letter, the Privacy Policy, and any Service-specific addenda) are the entire agreement between us in relation to the Services.
§16If you need legal help and can't afford it
We mention this because it matters. In Australia:
- Legal Aid Queensland (and equivalent commissions in other states) provides free legal help to people who meet means and merits tests. legalaid.qld.gov.au · 1300 651 188.

We do not benefit financially from your decision to engage or not engage a lawyer. We recommend you do. Even one hour of legal advice on a specific question, properly used, often saves disproportionate time and grief.
